  1. This website is owned and operated by the National Experience Network Team (“The Core Team”).

  2. A User is anyone who accesses the site, including those who do not formally register

  3. You must be aged sixteen or over to use the site and to participate in any of the experiences that are referred to on the site

  4. The Core Team cannot guarantee uninterrupted access to the website or any linked websites. The Core Team accepts no responsibility for any claims, losses or damages (either direct or indirect) arising from the unavailability of the website or any part of it, or any linked website

  5. Where the website contains links to third party websites, the Core Team is not responsible for the content of any third party website

  6. The Core Team cannot guarantee that any information submitted to it through the website or via email will arrive safely or be secure due to potential for interception by third parties

  7. If Users submit personal information to the Core Team through the National Experience Network website, they confirm that they agree to these Terms and Conditions and consent to the Core Team maintaining, recording, holding and using their personal information in accordance with the Privacy Policy. Please refer to the Privacy Policy for further details

  8. Content on the website is provided on an ‘as is’ basis and is provided for information only and cannot be considered to be endorsed or recommended by the Core Team

  9. The Core Team will not be responsible for, and excludes all liability in respect of, any claims, losses or damages (direct or indirect) arising out of or relating to the use of and/or reliance on the contents of the Website. In particular, the Core Team will not be held liable in defamation, breach of confidentiality or for intellectual property infringement, except to the extent that such liability cannot be excluded by law

  10. Users shall not reverse engineer, decompile, adapt or copy any software or other code or scripts that form part of the website nor attempt to transmit to or via the website any information that contains a virus, worm, Trojan, or other harmful or disruptive component

  11. Users may create hyperlinks to the website provided that the link is not used in any misleading or defamatory context, nor otherwise associated with any unlawful activity

  12. All material on the website is © National Experience Network and must not be used for commercial or other purposes by any third party. Users may not copy, modify, publish, transmit, distribute, perform, display or sell any of the Core Team’s proprietary material

  13. These Terms and Conditions are subject to change at any time and without notice. The most up-to-date version will be posted on the HSC Change Day website under ‘Terms and Conditions’ at the bottom of each Website page


Users Registering with the National Experience Network

  1. In order to apply for experiences Users must register on the Website. By registering on and applying to experiences on the website, Users agree:

    1. to comply with these Terms and Conditions in their use of the website

    2. to ensure that any details provided to the Core Team are up-to-date and accurate

    3. to post only content which is not owned in Copyright law by a third party unless permission has been sought to post such material(s)

    4. to not plagiarise answers to questions that may be asked of individuals applying to experiences

  2. By supplying an email address, Users agree that they will be subscribed to a newsletter, which they can opt out of at any time by contacting the Core Team, on an at-most quarterly basis

  3. Users shall only post material, which they have personally created, unless specific consent has been sought from the original creator of the material. Where material has been produced in the course of employment, permission to do so must be obtained from the relevant employer. The Core Team shall assume that such permission has been obtained where users post material on the website

  4. All registrations of individuals will be moderated by the Core Team. The Core Team reserve the right to refuse an individual to post to the site if the content that is posted is contrary to the Terms and Conditions or is deemed unsuitable for any other reason

  5. Users must not post contact details of individuals – either patients, employees or third parties of the NHS – in posts on the website.

  6. Users must not post any personal data of any person on the website, unless specific consent from that individual has been sought. The Core Team shall assume that such consent or authorisation has been obtained in respect of any such details posted by a User

  7. Posting of any material containing any confidential information of any third party by Users is prohibited. The Core Team accepts no liability for the posting of any such confidential information by any User

  8. Users warrant that material posted by them is not false, offensive, defamatory, threatening, obscene or unlawful

  9. Users acknowledge that in posting any content on the website, they warrant that they have the right to do so and grant the Core Team a royalty-free, non-exclusive right to reproduce, adapt and/or publish any content for the purpose of promoting or analysing HSC Change Day (including production of posters and other such documentation) and for the purpose of displaying content on the website

  10. We may, in our sole discretion, terminate or suspend your access to all or part of the service at any time, with or without notice, for any reason, including, without limitation, breach of this agreement

  11. You are responsible for maintaining the confidentiality of your username and password and you should not allow anyone to use your password to access any services. You are responsible for all usage or activity on the site by users using your password, including but not limited to, use of your password by any third party

  12. You are solely responsible for your interactions with other members, providers and applicants. You understand that the Core Team does not conduct criminal background checks on any of its members nor do we conduct any checks into the backgrounds of its members or investigate the statements of the members into the accuracy of such statements. The Core Team makes no representations or warranties as to the conduct of members or their compatibility with any current or future members. The Core Team reserves the right to conduct any criminal background check or other screenings at any time and using available public search records.

  13. In no event shall the Core Team be liable for any damages whatsoever, whether direct, indirect, general, special, compensatory, consequential, and/or incidental, arising out of or relating to the conduct of you or anyone else in connection with the use of the service, including without limitation, bodily injury, emotional distress, and/or any other damages resulting from communications or meetings with registered users of this service or persons you meet through this service. You agree to take reasonable precautions in all interactions with other members of the service, particularly if you decide to meet offline or in person. You understand that the Core Team makes no guarantees, either explicit or implied, regarding your ultimate compatibility with the individuals or experiences that you meet through the service.

  14. You should not provide financial information to members you meet through this service, this is a free of charge service and there is no need for money to change hands at any time and so providing bank details will ALWAYS be unnecessary

  15. Where an external link appears on this site you must familiarize yourself with their terms and conditions and Privacy Policy. You use any external links at your own risk with regards to any external links provided on this site to the websites of third parties.


Experience Applicants

  1. Users acknowledge that experiences are provided on an ‘as is’ basis. Whilst experiences will be screened for suitability by the Core Team, they will not accept any responsibility for the quality or for any undue events that occur as a result of an individual applying for an experience

  2. Some experiences may require a disbarring service check (a DBS, formerly a CRB check). Users accept that this cannot and will not be provided by the National Experience Network and must either be provided by the experience-providing organisation or the individual applying to the experience.

  3. It is expected that all individuals applying to an experience will be honest in respect of any previous convictions that may affect their suitability for a placement in a host organisation providing an experience. This clause takes into account The Rehabilitation of Offenders Act 1974, and in no way overrides the duties and expectations of experience providers or the National Experience Network in this regard

  4. Experience applicants who are successfully placed agree to produce one reflective piece of a minimum of 200 words and a review of 150 words with a ‘5-star rating’ before any evidence of partaking in an experience is provided by the National Experience Network, those who do not meet this Clause will be disbarred from the website and will not be permitted to apply for further experiences with the National Experience Network


Experience Providers

  1. Experience providers must have sought permission to provide an experience on the National Experience Network from the most suitable person in their organisation before submitting an experience to the National Experience Network

  2. Experience providers agree that their experience may be screened for suitability by the National Experience Network Core Team

  3. Experience providers agree that their experiences will provide school students, university students and health and social care professionals with relevant, CV-enhancing experiences and will actively encourage learning and personal development during the experience

  4. Experience providers agree that they may be assessed by the individual taking the experience placement and this may have a bearing on future acceptance by the National Experience Network for future placements

  5. Experience providers agree not to provide evidence of an individual partaking in an experience – this will be done by the National Experience Network working with the experience provider

  6. Experience providers must not use the data of applicants for any purpose other than for providing an experience. They must not, in particular, pass data on to third parties and must keep data about individuals secure and preferably password protected

Disclaimer of Warranties and Limitation of Liability

  1. You understand and agree that you use the website and its services at your own risk. Services are provided on an ‘as is’ basis without representations or warranties of any kind, whether expressed or implied, including but not limited to warranties of title, non-infringement or implied warranties of merchantability or fitness for a particular purpose, other than those warranties which are incapable of exclusion by law

  2. The Core Team proves online experiences for school students (sixteen years of age and above), university and college students and newly qualified professionals (of two years standing).

  3. The Core Team does not guarantee the accuracy, completeness, or timeliness of, or otherwise endorse any information contained on the website.

  4. We do not represent or endorse the accuracy or reliability of any member profile, statement, opinion or other information displayed or application presented to experience providers

  5. You acknowledge that any reliance upon any such opinion, member profile, advice, statement or information or application shall be at your sole risk. Your continued use of the service now, or following the posting of notice of any changes in this agreement will constitute a binding acceptance by you of this agreement, or any subsequent modifications

  6. You hereby acknowledge and agree that under no circumstances will the Core Team , its officers, directors, employees, agents and third party content providers or licensors be liable you or any third party for any loss whatsoever caused by your use or reliance on information obtained through the content distributed by the Core Team as well as any direct, indirect, accidental, incidental, special, punitive or consequential damages arising out of the use or inability to use the service or out of the breach of warranty or, or caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to and/or alteration of the website, no matter whether such claims are based in contract, tort, negligence, strict liability or any other cause of action regardless of whether the Core Team has been advised of the possibility of such damages

  7. Some jurisdictions limit the availability of such limitation of liability, in which case the provisions of this section may not apply to you. Notwithstanding the forgoing, in no event shall our liability exceed ten pounds sterling

  8. You hereby agree to indemnify, defend and hold harmless the Core Team and all officers, directors, owners, agents, information providers, affiliates, licensors and licensees (collectively, the ‘indemnified parties’) from and against all liability and costs including, without limitation, reasonable solicitors’ fees , incurred by the indemnified parties in connection with any claim arising out of any breach by you of this agreement or the foregoing representations, warranties and covenants. You shall cooperate fully as reasonably required in the defense of any such claim and the Core Team reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by you.

This Agreement represents the entire agreement between You and the Core Team regarding the use of our Services and supersedes any other agreement or understanding on the subject matter. This Agreement, Your rights and obligations, and all actions contemplated by this Agreement shall be governed by the laws of the United Kingdom. As a condition of using the Services, each user agrees that any and all disputes and causes of action arising out of or connected with the Core Team, shall be resolved through arbitration, with such arbitration to be held in London, England, United Kingdom.

Additionally, except where prohibited by law, as a condition of using the Services, You agree that any and all disputes and causes of action arising out of or connected to our Services shall be resolved individually, without resort to any form of class action. You also agree that regardless of any statute or law to the contrary, any claim or cause of action arising from or related to the use of the Services must be filed within one (1) year after such claim or cause of action arose or be forever barred. The failure of either party to exercise, in any respect, any right provided for herein shall not be deemed a waiver of any further rights hereunder.

If any provision of this Agreement is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that this Agreement shall otherwise remain in full force and effect and be enforceable.

Headings are for convenience only and have no legal or contractual effect.

All notices under this Agreement shall be in writing and shall be deemed to have been duly given when receipt is electronically confirmed, if transmitted by facsimile or email or upon receipt, if sent by certified or registered mail, return receipt requested.
